Առանց փողկապի և պաշտոնական ձևակերպումների․ ահա այսպես Տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովի նախագահը, բիզնեսի ու նրանց շահերի պաշտպանությամբ զբաղվող հասարակական կազմակերպությունների ներկայացուցիչներն այսօր հանդիպեցին, նախաճաշեցին և քննարկեցին տնտեսական մրցակցության ոլորտում առկա խնդիրները։
Հանդիպումը կազմակերպվել էր «Փաստերի վրա հիմնված բարեփոխումների ջատագովություն» ծրագրի շրջանակներում, որն իրականացվում է Ինֆորմացիոն տեխնոլոգիաների ձեռնարկությունների միության (ԻՏՁՄ), Իրավաբանների հայկական ասոցիացիայի (ԻՀԱ) և Եվրոպական բիզնես ասոցիացիայի (ԵԲԱ) կողմից:
ԻՏՁՄ իրավաբան Արկադի Սահակյանը ներկայացրեց bizprotect.am կայքը, որը ստեղծվել է բիզնեսի կողքին լինելու համար․ եթե ձեռնարկատերը որևէ խնդրի է հանդիպում, կարող է այս կայքի միջոցով նույնիսկ անանուն ահազանգել խնդրի մասին, մասնագետները կուսումնասիրեն հայտը և արագ կարձագանքեն դրան: Ի դեպ, արդեն իսկ կան հաջողության պատմություններ։ Ստեղծվել է նաև bizprotect.am կամ bizpashtpan.am բջջային հավելվածը, որի դեպքում հնարավոր է խնդրի մասին ահազանգել առավել արագ, հենց այն պահին, երբ առնչվում է խնդրին: Հավելվածը հնարավորություն է տալիս ոչ միայն տեքստային տեղեկություններ փոխանցել, այլև լուսանկարներ, փաստաթղթեր:
Իրավաբանների հայկական ասոցիացիայի իրավաբան Մարիամ Զադոյանը ներկայացրեց տնտեսական մրցակցության ոլորտում առկա մեծագույն խնդրի մասին՝ մենաշնորհների դեմ պայքարելու հարցին: Նրա խոսքով, դրա լավագույն լուծումը իրական սեփականատերերի ռեգիստրի ստեղծումն է: Եթե չկա իրական սեփականատերերին ներկայացնելու պարտավորություն, ապա կարող է մի անձը մի քանի կազմակերպություն ստեղծել (տարբեր անձանց անուններով) և զբաղվել նույն գործունեությամբ՝ փաստացի մենաշնորհային դիրք ունենալով շուկայում: Մինչդեռ իրական սեփականտերերին բացահայտելու ինստիտուտի առկայության դեպքում մենաշնորհների խնդիրը կլուծվի:
ՏՄՊՊՀ նախագահ Արտակ Շաբոյանը նշեց, որ տնտեսական մրցակցության ոլորտում կազմակերպությունների իրական սեփականատերերի ինստիտուտի ներդրմանը իրենք կողմ են։ Սակայն պետք է քննարկվեն այնպիսի ընթացակարգային հարցեր, ինչպիսիք են, թե որ մարմնի կողմից և թե ինչպես է իրականացվելու վերահսկողությունը, և այլն։
Ա․ Շաբոյանը խոսեց նաև ՏՄՊՊՀ-ի գործունեությունը կարգավորող օրենսդրությունում որոշ փոփոխությունների, մասնավորապես առավել լայն լիազորություններով օժտելու անհրաժեշտության մասին․ մասնավորապես, որոշ դեպքում անհրաժեշտություն է լինում հակամրցակցային խախատումներ բացահայտելու համար ունենալ օպերատիվ-հետախուզական լիազորություններ։
Անկեղծ քննարկումների արդյունքում վերհանված խնդիրների համակարգման և դրանց լուծումների ուղղությամբ հետևողական քայլեր կձեռնարկվեն։
