Պետական գնումների մրցույթին տնտեսվարողին կարող են թույլ չտալ մասնակցել՝ չնչին ֆինանսական պարտավորություն ունենալու դեպքում․ այս մասին Bizprotect.am կայքի միջոցով ահազանգել էր Լոռու մարզում գործող տնտեսվարողը։
«Գործարարները հայտարարություն են տալիս պետական գնումների տենդերին մասնակցելուց առաջ, որ պետության նկատմամբ չունեն որևէ պարտավորություն, սակայն տեխնիկական պատճառներով ընդամենը 70 դրամ պարտավորության դեպքում դիտարկվում է, որ հայտարարությունը կեղծ է, զրկվում են մրցույթին մասնակցելու հնարավորությունից, և տուգանք է առաջանում: Նման կարգավորումները խոչընդոտում են բիզնեսի զարգացմանը: Առաջարկում ենք, որ փոքր շեղումների համար բացառություններ նախատեսվեն»,- գրել է տնտեսավարողը։
Նշենք, որ հուլիսի 7-ին ընդունվել է «Ազդարարման համակարգի մասին» ՀՀ օրենքը, որով նախատեսված է անանուն ահազանգման հարթակի ստեղծումը 2018թ.-ին: Սակայն, «Փաստերի վրա հիմնված բարեփոխումների ջատագովություն» ծրագրի շրջանակներում արդեն իսկ ստեղծվել է Bizprotect.am կայքը, որը ազդարարման հարթակ է` ուղղված բիզնես ոլորտի գործունեությանը խոչընդոտող ցանկացած հարցերի, ռիսկերի և խնդիրներին, ներառյալ` կոռուպցիոն: Սույն կայքը նաև անանուն ահազանգներ ներկայացնելու հնարավորություն է ընձեռում: Այդ ահազանգերի իսկությունը ստուգելու և դրանց լուծումներ տալու համար ձեռնարկվում են համապատասխան քայլեր:
Ծրագրի իրավաբան Մարիամ Զադոյանը նշեց, որ այս ահազանգի կապակցությամբ գրություն է ուղարկել ֆինանսների նախարարություն։ Փոխնախարար Արմեն Հայրապետյանը պատասխանել է, որ այս տարվա ապրիլի 25-ից ուժի մեջ մտած «Գնումների մասին» նոր օրենքով այս հարցը կարգավորվել է։ Մասնավորապես, օրենքի 6-րդ հոդվածի 1-ին կետի 2-րդ ենթակետով սահմանված է, որ գնումների ընթացակարգերին մասնակցելու իավունք չունեն այն անձիք, որոնք հայտը ներկայացնելու օրվա դրությամբ հարկային մարմնի կողմից վերահսկվող եկամուտների գծով ունեն իրենց ներկայացրած գնային առաջարկի մինչև մեկ տոկոսը, բայց ոչ ավելի, քան 50 000 դրամը գերազանցող ժամկետանց պարտավորություններ։
Կառավարության այս տարվա մայիսի 4-ի 526-Ն որոշման համաձայն, գնման մրցույթի մասնակցի ժամկետանց հարկային պարտավորություններ ունենալու հանգամանքը ստուգվում է ՊԵԿ-ի կողմից։
«Հայտնում ենք, որ եթե առաջին տեղը զբաղեցրած մասնակիցը, համաձայն Պետական եկամուտների կողմիտեի կողմից տրամադրված տեղեկատվության, հայտը ներկայացնելու օրվա դրությամբ հարկային մարմնի կողմից վերահսկվող եկամուտների գծով չի ունեցել վերոնշյալ շեմը գերազանցող ժամկետանց պարտավորություններ, ապա վերջինս չի զրկվում գնման գործընթացին հետագա մասնակցությունից»,- պատասխանել է փոխնախարար Արմեն Հայրապետյանը։
