There should be a unified approach to the responsibility of legal entities: Conference on Judicial Reforms Held

On September 27, the Civil Society-Government Conference “2019-2023 RA Judicial and Legal Reforms Strategy in the Context of Increasing Public Trust” was organized within the framework of the EU-funded Commitment to Constructive Dialogue (CCD) project by the Armenian Lawyers’ Association (ALA), the Ministry of Justice of the Republic of Armenia and the Committee on State and Legal Affairs of the Public Council.

Ms Mariam Zadoyan, Lawyer/Attorney and Manager of the ALA component in the “Armenia: Promoting Anti-Corruption Conduct and Reforms” Project made suggestions and observations during the conference. She directed her question to the law enforcement officials: "ALA praises the inclusion of a clause on foreseeing criminal liability of legal persons in the “2019-2023 RA Judicial and Legal Reforms Strategy". A new Criminal Code draft is being circulated, which provides for some exceptions that would enable the legal entity to evade liability, when the latter had undertaken all possible steps to ensure that the violation would not occur. Will the same positioning continue in that period when this strategy is projected? That is, would it be possible to provide for an exemption from liability in case anti-corruption compliance programs are in place in businesses?”

In response to his question, Mr. Grigor Amiryan, Chief Prosecutor of the Department for Charge Defense and Appealing of Judicial Acts of the Prosecutor’s Office of the Republic of Armenia, noted that the time to settle the issue of legal responsibility for legal entities had come, but there are many nuances to consider. Mr. Arsen Ayvazyan, Deputy Chairman of the RA Investigation Committee noted that referring to the issue of criminal liability of legal entities is welcomed and added that a united approach should be taken in this matter.
